1. Acceptance of Terms

Welcome to PIQUE INTERACTIVE. By accessing or using our platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the platform.

PIQUE INTERACTIVE is a collaborative soundboard platform that enables producers to create and manage soundboards, trigger audio in real-time, control DMX lighting, and facilitate audience participation for live events.

2. Definitions

  • Platform: The PIQUE INTERACTIVE website, application, and all related services.
  • User: Any individual or entity using the platform, including producers, consumers, and audience participants.
  • Producer: An account holder who creates, manages, and hosts soundboards and interactive sessions.
  • Consumer: An account holder with view and playback access to soundboards.
  • Content: All audio files, soundboards, configurations, and data uploaded or created by users.

3. Eligibility and Account Requirements

You must be at least 18 years old to create an account and use the platform. By creating an account, you represent and warrant that you have the legal capacity to enter into these Terms.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. User Roles and Access

PIQUE INTERACTIVE provides different user roles with varying permissions:

  • Producers: Create and manage soundboards, host sessions, configure DMX lighting, and control audience participation.
  • Consumers: View and play sounds from soundboards they have access to.
  • Administrators: Manage users, oversee platform usage, and configure system-wide settings.
  • Audience Participants: Join public sessions via share links to request sounds, vote, submit questions, or participate in interactive features.

5. Content Ownership and Licensing

Your Content: You retain all ownership rights to the audio files and content you upload to the platform. By uploading content, you grant PIQUE INTERACTIVE a non-exclusive, worldwide license to store, process, and deliver your content as necessary to provide the platform services.

Your Responsibility: You are solely responsible for ensuring that you have the necessary rights, licenses, and permissions to upload and use any content on the platform. You agree not to upload content that infringes on the intellectual property rights of others.

Third-Party Content: The platform may provide access to third-party sound libraries and content repositories. Use of such content is subject to the terms and licenses of those third-party providers.

6. Acceptable Use Policy

You agree not to use the platform for any unlawful or prohibited purpose. Prohibited activities include, but are not limited to:

  • Uploading content that infringes on intellectual property rights or violates copyright laws
  • Uploading content that is defamatory, obscene, abusive, hateful, or threatening
  • Using the platform to harass, threaten, or harm others
  • Attempting to gain unauthorized access to the platform, user accounts, or systems
  • Interfering with or disrupting the platform's operation or servers
  • Using automated systems or bots to access the platform without permission
  • Transmitting viruses, malware, or other harmful code
  • Collecting or harvesting personal information of other users without consent
  • Impersonating any person or entity or misrepresenting your affiliation

Violation of this policy may result in the suspension or termination of your account and, in severe cases, legal action may be taken.

7. Third-Party Integrations

PIQUE INTERACTIVE integrates with third-party services including Spotify, Open Trivia DB, sound repositories, and DMX/OSC bridges. Your use of these integrations is subject to the terms and policies of those third-party services. We are not responsible for the availability, content, or practices of third-party services.

8. Service Availability and Modifications

We strive to provide reliable service but do not guarantee that the platform will be available at all times without interruption. We may modify, suspend, or discontinue any aspect of the platform at any time without prior notice.

We reserve the right to impose limits on features, storage, or usage as necessary to maintain platform performance and security.

9. Data and Backups

While we implement reasonable backup procedures, you are responsible for maintaining your own backups of important content. We are not liable for any loss of data or content.

10. Limitation of Liability

To the fullest extent permitted by law, PIQUE INTERACTIVE and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to loss of data, loss of revenue, or loss of business opportunities.

The platform is provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

11. Indemnification

You agree to indemnify, defend, and hold harmless PIQUE INTERACTIVE and its operators from any claims, liabilities, damages, losses, and expenses arising from your use of the platform, your violation of these Terms, or your violation of any rights of others, including intellectual property rights.

12. Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms or for any other reason at our sole discretion. You may terminate your account at any time by contacting support.

Upon termination, your right to use the platform will immediately cease. We may delete your content and account data following termination, subject to our data retention policies and legal obligations.

13. Changes to Terms

We may update these Terms of Service from time to time. If we make material changes, we will notify you through the platform or via email. Your continued use of the platform after such changes constitutes your acceptance of the updated Terms.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the platform shall be resolved through good faith negotiation. If negotiation fails, disputes may be subject to binding arbitration or court proceedings as permitted by law.
